A. The Craftsman doing this work is not authorized to make any representations or agreements other than those set forth herein in writing and any such representations by the craftsman are hereby disclaimed by Damian John Construction LLC, dba Damian John Installations (hereinafter “the company”). All labor proposals are valid for 90 days. If the craftsman terminates his association with the company or becomes unavailable before work has started (beyond materials purchase), the company will provide an equally qualified craftsman.


B. If the work ordered is not started by the promised date, the company must offer the choice of (1) Cancelling your contract with a prompt, full refund of any payments you have made, or (2) Accept starting work at a later date.


C. All amendments to the scope of work on this contract shall be in writing, dated and signed by the craftsman and the customer. The customer agrees to pay for all work performed at job site on their behalf.


D. The customer may supply all materials or ask the craftsman to select and deliver materials. The customer shall pay for all materials separate from labor and agrees to reimburse the craftsman and/or the company for any materials purchased for work on this contract. The customer assumes the responsibility for all aspects of materials, including color, texture, style and quality. There is no warranty on materials purchased by the company and no reimbursement for materials will be made under any circumstances. Should the materials fail to perform properly, the customer will be responsible to pay the company for work performed to remove or replace the defective materials. Manufactures warranties will be supplied if available or can be obtained from the supplier.


E. The customer will obtain and arrange for all permits, licenses and inspections required for work on this contract. The company /craftsman is not responsible for any changes or additions requested/required by the inspector. Work performed by the company to accommodate inspector requested/required changes will be considered an amendment to the contract. See section C.


F. The customer and/or property owner is responsible for any hazardous materials such as asbestos, lead, etc. associated with this job and should notify the company of the presence of such hazardous materials prior to the commencement of work.


G. Cancellation Policy: Customer must cancel no less than two business days (48 hours) before work is to start. Cancellation charges apply based on the volume of work scheduled, and range from $150.00 to $400.00.


H. Interim payments, made payable only to the company upon reaching agreed upon stages of completion, are acceptable.


I. The customer agrees to make complete payment (“Balance Due”) to the company at the completion of work. The customer’s signature under “Work Inspected and approved” indicates completion and acceptance of all work defined on the contract. The customer agrees to pay for all work performed under this contract. The company, at its option, has the right to refund a portion of the payment in lieu of completion of work or warranty service.


J. All checks and/or payments for labor must be made payable to Damian John Installations or Damian John Construction LLC. Any payment for labor made directly to a craftsman voids all guarantees/warranties associated with this agreement and may subject customer to additional charges.


K. A surcharge of $35 (or the maximum allowed by law) will be assessed on all return checks and all reversed credit card charges. The customer agrees to pay all collection fees/legal fees/court costs should nonpayment result in action to collect a debt. Interest on unpaid balances accrues at 2 1/2% per month.


L. The company is not responsible for any money paid to parties other than Damian John Installations or Damian John Construction LLC.


M. The terms of the warranty are shown below. The warranty is for labor only and does not cover materials associated with the job. Incomplete payments, regardless of the reason, nullifies the warranty. Repairs made under warranty does not extend the original one-year warranty. No warranty on any faucet or valve repairs and/or rebuilding. There are no other warranties expressed or implied, and there is no liability for consequential damages of any nature or kind. This contract and the warranty are not transferable.


N. OWNER is advised and understands that performance of this work is subject to the existing conditions and the typical limitations of repairs for matching paint, texture, stain, or other existing conditions. The company will take ordinary trade practice efforts to achieve a reasonable match as permitted by existing conditions, however an exact match is not promised or guaranteed. 

       

Warranty

For one (1) year from the date of this contract, Damian John Construction LLC dba Damian John Installations will repair, free of charge, defects in workmanship performed pursuant to this contract. This warranty becomes effective when your complete payment made payable to Damian John Installations has been credited to our account. Warranty service is available by simply contacting our office phone number shown on your invoice. There are no other warranties expressed or implied, and there is no liability for consequential damages of any nature or kind. Warranty is for labor only and materials are not included. This warranty expressly excludes any faucet or valve repairs.
